To give you a better understanding of why this is
important, I'd like to tell you a little story. It's called:
The Real Estate Shell Game: Buyer and Seller
Beware.
One day John and Sally LaSale decided to sell their
home. When they bought the house a few years ago from the listing
agent, their best interests weren't represented and they paid too
much. Now that they are selling they are quite excited because they
feel it's their turn to get the highest price.
They see an ad in the local paper for Moe Munee.
Moe's ad states he sold more homes than anyone in the area last
year. John turns to Sally and says, "Gee Sally this guy really
seems to know his stuff, he should be a big help in negotiating
the highest price for the sale of our home. Let's give him a call."
Sally agrees, picks up the phone and schedules an appointment for
that evening. Moe shows up in his fancy car and shiny shoes and
says, "My job is to help you sell your home at the highest
price possible". Moe continues on about how he will promote
the home and tells John and Sally he may already have a buyer that
would be interested in their home. Moe says he would like to set
up some appointments, " if you could sign this dual agency
agreement I will bring them over tomorrow". John and Sally
cheerfully agree.
Across town at that very moment a young couple,
Peter and Joan DeBier are reading a real estate magazine and thinking
about buying their first home. They see an ad for a buyer agent,
his name is... you guessed it, Moe Munee. The ad states that as
a buyer agent Moe can help the buyers every step of the way. Peter
turns to Joan and says, "Gee Joan this guy really seems to
know his stuff he should be a big help in negotiating the lowest
price for the purchase of our home". Joan agrees, picks up
the phone and makes an appointment for that evening. Moe shows up
in his fancy car and shiny shoes and says, "My job is to help
you buy your home at the lowest price possible". Moe continues
on about how he will assist them every step of the way and tells
Peter and Joan the home he listed last night would be perfect for
them. Moe says he would like to set up an appointment," if

tomorrow“. Peter and Joan cheerfully agree.
So Moe Munee takes Peter and Joan DeBier over to
see John and Sally LaSale's house, they like it and ask Moe to help
them negotiate the purchase. Moe says, "I'm sorry even though
you still have to pay my full commission the dual agency disclosure
states I can't fully represent your interests on this purchase“.
Peter and Joan are more than a little annoyed but they like the
house and come up with an offer for Moe to present.
Now Moe takes the offer over to John and Sally
and presents it. John and Sally are happy to have an offer and ask
Moe to help them negotiate the sale. Moe says, "I'm sorry even
though you still have to pay my full commission the dual agency
disclosure states I can't fully represent your interests on this
sale“.
What just happened?
John and Sally LaSale had to proceed with the largest
transaction of their life without full representation.

Peter and Joan DeBier had to proceed with the largest
transaction of their life without full representation.
Bad for Peter and Joan Debier.
Moe got paid twice without having to fully represent
either party!
Really, really good for Moe!
Both parties called a very talented general practitioner,
for the largest transaction of their life. If you needed life or
death surgery you wouldn't call a general practitioner, no matter

There is a difference
If the agent is not working for you as a buyer
broker, that agent is working as a transaction broker or for the
seller as a seller's agent, not for you. You are the agent's customer
not his client. A seller's agent must treat you fairly and can't
misrepresent any material facts about the property, but he must
try to get the most money and the best terms for the seller, not
you. He must, by law, tell the seller everything he has been able
